The Service allows users to upload photos, serial numbers, descriptions, and other data related to their property.
3. No Insurance Guarantees or Financial Advice
Please read this section carefully.
3.1. Information Only
The Service is strictly an organizational and documentation tool. The data you enter into the Service (including valuations, condition reports, and existence of items) is for your personal record-keeping only.
3.2. No Insurance Affiliation
Rampart Asset Management is not an insurance provider, insurance broker, or insurance adjuster. We do not underwrite risk or issue insurance policies.
3.3. No Guarantee of Claims or Payouts
The use of this Service does not guarantee that any insurance claim you submit to a third-party provider will be approved, processed, or paid out.
- We do not verify the authenticity, ownership, or value of the assets you record.
- We do not guarantee that the reports generated by the Service will be accepted as "proof of loss" by your specific insurance provider.
- You are solely responsible for understanding the documentation requirements of your insurance policy.
3.4. Valuation Disclaimer
Any estimated values provided by the user or third-party integrations within the App are estimates only and should not be considered professional appraisals.
4. User Responsibilities
4.1. Accuracy of Data
You are responsible for the accuracy, truthfulness, and completeness of the data you enter. Rampart Asset Management is not liable for errors in your inventory that result in financial loss or rejected insurance claims.
4.2. Data Backup
While we strive to protect your data, you are encouraged to maintain external backups of your asset lists and photos.
4.3. Account Security
You are responsible for safeguarding the credentials used to access the Service.
5. Intellectual Property
The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of Rampart Asset Management and its licensors.
6. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Rampart Asset Management, its officers, directors, employees, agents, affiliates, or licensors be liable to you or any third party for any indirect, incidental, special, consequential, punitive, or exemplary damages whatsoever. This includes, without limitation, damages for loss of profits, loss of goodwill, loss of data, work stoppage, computer failure or malfunction, or any other commercial damage or losses, arising out of or in connection with:

- 6.3 Any unauthorized access to, alteration of, or data loss regarding your digital inventory or account;
- 6.4 Any temporary or permanent service interruptions or errors.
7. Maximum Aggregate Liability (Cap)
To the maximum extent permitted by applicable law, Rampart Asset Management's total, cumulative, and aggregate liability arising out of or relating to these Terms or your use of the Service—for any and all claims under any legal theory—shall be strictly limited to the greater of:

Some states, jurisdictions, or federal laws do not allow the exclusion or limitation of implied warranties, incidental damages, or consequential damages. In such jurisdictions, Rampart Asset Management's liability shall be limited to the fullest and maximum extent permitted by applicable law.
8. Account Deactivation and Termination Policy
In the event your account is deactivated or terminated:
8.1. Termination by User
You may cancel your subscription through your account settings or by contacting our support team. Upon user-initiated cancellation, your subscription will remain active until the end of your current billing cycle, after which your account will transition to a deactivated status.
8.2. Deactivation for Non-Payment
- 8.2.1 Payment Failure: If we are unable to process your recurring subscription fee on the scheduled payment date (e.g. due to an expired card, insufficient funds, or payment processing error), your account will enter an administrative grace period.
- 8.2.2 Service Suspension: If payment is not successfully processed within seven (7) days following a payment failure, your account will be deactivated. During deactivation, your access to the Service, including the ability to add, edit, or export inventory data, will be suspended.
8.3. Termination for Breach of Terms
We reserve the right to immediately suspend or terminate your account without prior notice, or refund, if:
- 8.3.1 You breach any provision of these Terms (including, without limitation, engaging in any activities in the Acceptable Use and Prohibited Activities section);
- 8.3.2 We are required to do so by applicable law, court order, or regulatory authority;
- 8.3.3 Your continued use of the Service poses a security, technical, or legal risk to Rampart Asset Management, our system, or other users.
8.4. Data Retention and Deletion Following Deactivation or Termination
- 8.4.1 30-day Data Retention Period: In the event of account deactivation due to non-payment or voluntary cancellation, Rampart Asset Management will securely store your account inventory data for thirty (30) calendar days from the date of deactivation. This grace period provides you with the opportunity to reactivate your account by settling outstanding balances or renewing your subscription without losing your digital inventory records.
- 8.4.2 Permanent Data Purge: If your account is not reactivated within thirty (30) calendar days following your deactivation, or if your account is terminated for material breach of these Terms, Rampart Asset Management reserves the right to permanently delete all digital inventory files, receipts, photos, and associated records from our servers. Once data is permanently deleted, it cannot be recovered or restored.
